WA Surplus Line Filing Process & Requirements

All surplus line insurance coverages written by members of the Association on Washington risks (per RCW 48.15.120) are to be submitted to the Surplus Line Association of Washington.

The following Rules shall apply to such submissions:

Required Policy Documents

The Surplus Line Association of Washington requests that submissions be kept to the items listed below. The entire policy should not be filed.

  • Policy Declarations Page or Lloyd’s of London Covernote
  • Supplemental Declarations (if applicable)
  • Schedule of Forms and Endorsements
  • Service of Suit Endorsement

The certification form required by RCW 48.15.040 is generated through the Washington Filing Portal electronically using the policy data provided. The surplus line broker must follow the prompts to certify the accuracy of the certification form to meet this requirement.

(3)  Upon receipt of a filing, the Association’s Examination Department will review and register the filing or issue a TAG for correction. TAGS indicate that there is an error with the filing, which needs correction before the transaction can be registered.

(4)  The Surplus Line Association of Washington provides a copy of filed certification forms to the Office of the Insurance Commissioner upon receipt. Certified transactions will appear on the appropriate Annual Tax Statement, regardless of whether the transaction has been registered. Changes to the certification form can be made until the account is registered.

(5)  The notice of a “Registered” certification form and a copy of coverages is considered a complete copy of the filing for the broker’s records.

Endorsements

Endorsements or other modifications of coverages previously submitted should be filed promptly.

  • Endorsements with additional or return premiums must include the itemization of premium, taxes and fees.
  • Non-money endorsements need not be filed, except for changes of security or policy number.

Itemization of Premium, Taxes and Fees:

Each premium bearing filing must include the following itemized charges listed on the declarations page:

  • Premium
  • Policy Fees
  • Other Fees (if applicable)
  • State Tax
  • Stamping Fee

Refer to Taxes & Fees or use the Tax Calculator to determine the applicable stamping fee rate, based on the transaction type and effective date of the policy. State tax and stamping fee are based on the sum of all premiums and fees, including but not limited to policy, broker and/or inspection fees.

Washington Registry Stamp

WAC 284-15-030 requires the following statement to be stamped conspicuously on the face of every surplus line coverage contract. The statement must be initialed by or bear the name of the surplus line broker who procured it:

This contract is registered and delivered as a surplus line coverage under the insurance code of the State of Washington, Title 48 RCW. It is not protected by any Washington State Guaranty Association Law.

Listing of Insurers in each Certificate of Coverage: 

The full names of all insurers assuming liability and their respective percentage of such liability should be clearly listed on the Certificate of Coverage.

Confidentiality Policy

All documents submitted to the Surplus Line Association of Washington through the Washington Filing Portal, shall not be divulged to, or be open to inspection by any third party, except the Insurance Commissioner or other governmental agency having legal authority, therefore. Provided, however, that the Board of Directors may, by resolution adopted by a majority of its members, allow or require the Executive Director to disclose specific types or categories of information in accordance with the terms, conditions, and limitations of such resolution.
